These Terms of Service ("Terms") govern your use of Closer - Couple Widgets ("Closer"), provided by Yannick Westermann, Theresienstraße 51, 80333 Munich, Germany ("we", "us", or "our"). By using Closer, you agree to these Terms.

Eligibility

You must be at least 16 years old to use Closer and legally capable of entering into these Terms. Do not use Closer if applicable law prohibits you from doing so.

The service

Closer allows two users to pair and share relationship content through an iOS app, widgets, and notifications. Features include moods, presence, love notes, moments, memories, songs, anniversaries, visits, distance, partner time, and interactive signals. Some features require an internet connection, compatible Apple hardware and software, device permissions, a paired partner, or a paid Closer Pro entitlement.

Closer may allow you to continue without linking an Apple account by creating an anonymous backend account. Anonymous accounts may not be recoverable after you lose access to the device or session. Sign in with Apple can improve account recovery, but you remain responsible for access to your Apple account and device.

Your partner and your content

You keep ownership of content you submit. You grant us a limited, non-exclusive license to host, process, compress, transmit, and display that content only as needed to operate, secure, and improve Closer.

Content you share is intended for your linked partner. You are responsible for ensuring that you have the rights and permissions needed to share it. Do not submit unlawful, threatening, abusive, exploitative, infringing, deceptive, or malicious content, or intimate content without every depicted person's consent.

Unpairing ends the normal partner-sync relationship. It cannot erase copies, screenshots, or cached content already held by your partner. Choose carefully what you share.

Location and safety

The distance and partner-time features use device location and may update in the background if you grant "Always" location permission. Location, city labels, distance, time zones, and timestamps can be delayed, approximate, unavailable, or incorrect. Closer is not a safety, emergency, navigation, surveillance, or proof-of-presence service. Do not rely on it to locate a person or make urgent decisions.

Use location sharing only with a partner you trust. You can change permission in iOS Settings and can unpair in Closer.

Closer Pro and purchases

Closer's core relationship loop is available without payment, subject to the limits shown in the app. The current free tier permits a limited number of intentional partner-facing updates per person per UTC day. Closer Pro may remove that limit and unlock additional widget families. One active entitlement may provide access to both users in a linked couple. Available products, prices, billing periods, trials, and features are shown in the App Store purchase screen and may change prospectively.

  • Purchases are made through your Apple account and processed by Apple.
  • Recurring subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, subject to Apple's applicable subscription terms.
  • You can manage or cancel a subscription in your Apple account's subscription settings or through the management option in Closer. Deleting Closer or unpairing does not cancel an Apple subscription.
  • Lifetime purchases are one-time, non-consumable access for the Apple account and entitlement recognized by Apple and RevenueCat; they do not guarantee that every present feature will remain unchanged forever.
  • Purchase restoration requires the Apple account used for the purchase and depends on Apple and RevenueCat availability.
  • Apple controls billing and refund eligibility. Request refunds through Apple's refund service or Apple Support. We cannot issue App Store refunds directly. Mandatory consumer rights remain unaffected.

Acceptable use

You must not:

  • Access another person's account or data without permission.
  • Use Closer to stalk, threaten, harass, coerce, exploit, or monitor someone without their informed agreement.
  • Attempt to bypass pairing, authentication, quotas, subscription checks, or security controls.
  • Reverse engineer, disrupt, overload, scrape, or misuse the service except where applicable law expressly permits it.
  • Upload malware or content that violates law or another person's privacy, publicity, intellectual-property, or other rights.
  • Use Closer for commercial resale or to build a competing dataset or service without written permission.

We may restrict or terminate access where reasonably necessary to protect users, comply with law, enforce these Terms, or secure the service.

Third-party services

Closer depends on Apple, Supabase, RevenueCat, PostHog, and Songlink/Odesli. Their services and terms may affect feature availability. Music links open third-party sites or apps, and we are not responsible for their content, availability, or practices. Your use of Apple services and the App Store is also subject to Apple's terms.

Privacy

Our Privacy Policy explains what data Closer processes, how linked partners receive shared content, and how to request access or deletion. Device permissions can be managed in iOS Settings.

Account deletion

You can start deletion under Settings → Account → Delete account. For complete backend deletion or a data request, email yannick@closertoyou.app. Deleting an account does not cancel an Apple subscription; manage that separately through Apple.

Intellectual property

Closer, excluding user content, and its software, design, branding, illustrations, and other materials are owned by us or our licensors and protected by applicable law. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use Closer for its intended purpose.

Availability and changes

We may update, add, remove, suspend, or discontinue features for operational, legal, security, or product reasons. We aim to provide a reliable service but do not promise uninterrupted, error-free, or permanent availability. Widget refreshes and notifications are partly controlled by iOS and may be delayed or throttled.

Disclaimer and liability

Closer is provided with the level of care required by applicable law. To the maximum extent permitted by law, we do not make additional warranties about uninterrupted availability, fitness for a particular purpose, or the accuracy of partner, location, time, or widget information.

We are liable without limitation for intent, gross negligence, injury to life, body, or health, fraudulent concealment, guarantees we expressly give, and liability required by product-liability or other mandatory law. For ordinary negligence involving an essential contractual duty, liability is limited to foreseeable damage typical for this contract. Otherwise, liability is excluded to the extent permitted by law. Nothing in these Terms limits mandatory consumer rights.

Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your habitual residence. Statutory rules determine the competent court; where a venue agreement is legally permitted, Munich, Germany is agreed as the venue.

Changes to these Terms

We may update these Terms to reflect changes to Closer, law, security requirements, or third-party services. We will provide notice when required. Continuing to use Closer after an effective update constitutes acceptance only to the extent permitted by law.
